Terms of Service

Please read these Terms of Service carefully before using Waevin. By creating an account or using the platform, you agree to be bound by them. If you do not agree, do not use the platform.

1. Acceptance and eligibility

Waevin is available to UK residents aged 18 and over only. By registering an account you confirm that you are a UK resident, that you are at least 18 years old, and that you have the legal capacity to enter into a binding agreement.

Your acceptance of these Terms is recorded with a timestamp at the point of registration for compliance purposes. If you register on behalf of a business, you warrant that you have authority to bind that business.

We reserve the right to refuse access to anyone at our discretion, including where we have reason to believe eligibility requirements are not met.

2. Platform nature

Waevin operates as a marketplace platform. We provide the technology, tools, and buyer protection framework through which buyers and sellers can transact. We are not a party to the contract of sale between buyer and seller.

The contract of sale is formed directly between the buyer and seller at the point of purchase. Waevin is not the seller of any item listed on the platform unless explicitly stated.

Our role is to facilitate transactions, hold funds in escrow, and administer the Buyer Protection programme. We do not take ownership of, inspect, or guarantee the quality of any items listed or sold through the platform.

3. Account registration

  • You must provide accurate, complete, and current information when registering. Providing false information — including false confirmation of UK residency or age — is grounds for immediate account termination.
  • You may hold only one account per person. Creating multiple accounts to circumvent restrictions or exploit promotions is prohibited.
  • Two-factor authentication (TOTP) is mandatory on all accounts. You must set it up before you can list items or make purchases.
  • You are responsible for maintaining the security of your account and password. Do not share your credentials with anyone.
  • You must notify us immediately at legal@waevin.com if you believe your account has been accessed without your authorisation.
  • Your username is public and may be visible to other users. Choose it carefully — we will not change it except in exceptional circumstances.

4. Seller obligations

By listing an item for sale, you warrant and agree to the following:

  • You own the item and have the right to sell it. You have not stolen it, and it is not subject to any lien, charge, or legal dispute.
  • All information in your listing is accurate. Card name, set, card number, edition, condition grade, and photographs must all accurately represent the physical item you are selling.
  • You must use Waevin's defined condition grades (Mint, Near Mint, Excellent, Good, Played, Poor) and apply them accurately. Overstating condition is grounds for a dispute ruling against you.
  • Photographs must be of the actual item you are selling, not stock images or photos of a different copy.
  • You must dispatch the item within 3 working days of payment being confirmed. Failure to dispatch without communication may result in an automatic dispute ruling in the buyer's favour.
  • All shipments must include tracked postage. You are responsible for ensuring the item arrives at the buyer's address in the condition described.
  • You must comply with the Prohibited Items policy in section 6.
  • You are responsible for any tax obligations arising from your sales, including VAT and income tax. Waevin does not act as your tax agent.

5. Buyer obligations

  • When you confirm a purchase, you enter into a binding agreement to pay. Repeatedly initiating purchases and abandoning them without completing payment may result in account restrictions.
  • You must confirm receipt of your order promptly once delivered. Escrow will be held open for up to 48 hours after tracked delivery confirmation, after which funds are automatically released to the seller.
  • Disputes must be raised honestly and only where you have a genuine concern. Raising false or vexatious disputes to delay payment to a seller is prohibited and may result in account suspension.
  • You must not attempt to complete transactions outside of the Waevin platform in order to avoid fees or protections. Doing so voids your Buyer Protection for that transaction.

6. Prohibited items

The following items are strictly prohibited on Waevin:

  • Counterfeit trading cards of any kind.
  • Proxy cards — cards not produced by the original manufacturer, intended to resemble genuine cards.
  • Altered or modified cards, unless explicitly and clearly disclosed as custom art cards, altered art cards, or fan-made art. Disclosure must appear in the listing title and description.
  • Stolen property.
  • Items whose sale would be unlawful under UK law.
  • Non-TCG items, unless Waevin has specifically permitted a category.
  • Graded cards whose grading has been manipulated, or cards relabelled with a higher grade than awarded.

Listings of prohibited items will be removed without notice. Sellers who repeatedly list prohibited items, or who knowingly list counterfeits, face permanent suspension and may be reported to trading standards or the relevant IP holder.

7. Listings

Waevin reserves the right to remove or modify any listing at any time and without notice, for any reason including but not limited to suspected policy violations, buyer complaints, or platform quality standards.

Sellers are solely responsible for the accuracy of their listings. Misleading listings — including inaccurate condition grades, incorrect card details, or photographs not of the actual item — may result in listing removal, dispute rulings against the seller, and account suspension.

Listings remain active until the item is sold, the seller removes it, or TCG Assistant removes it. Sellers may deactivate listings at any time, provided no purchase is pending.

8. Fees

Waevin charges no fees to sellers. There are no listing fees, no commission, and no deductions from the sale price. Sellers receive exactly the amount they list their card for.

A Buyer Protection fee is added to the buyer's total at checkout. This fee is mandatory, non-refundable (except where Waevin issues a full refund following a dispute), and calculated as follows:

The Buyer Protection fee is applied to the item price only. Postage is always charged at cost, set by the buyer's chosen shipping service. The fee can never exceed £80 regardless of item price.

9. Payments and escrow

All payments are processed by Stripe. When a buyer completes a purchase, the full amount (item price + postage + Buyer Protection fee) is charged immediately and held in escrow on the Waevin platform account. No funds are transferred to the seller at this point.

Escrow is released to the seller when one of the following occurs:

  • The buyer confirms receipt of the item through the Waevin platform.
  • 48 hours pass after the tracking information confirms delivery, and the buyer has neither confirmed receipt nor raised a dispute.

If a dispute is raised, escrow is frozen until the dispute is resolved by a TCG Assistant administrator. No funds can be transferred to the seller or refunded to the buyer while a dispute is active.

Released funds land in the seller's Waevin wallet. Sellers can withdraw their available balance to their connected UK bank account at any time, subject to the withdrawal conditions in section 12.

10. Buyer Protection

The Buyer Protection programme covers the following situations:

  • Item not received: tracking confirms the item was not delivered.
  • Item significantly not as described: the item differs materially from the listing (for example, a different card, a clearly incorrect condition grade, or undisclosed damage).
  • Item damaged in transit: the item arrived in a significantly worse condition than described due to damage during shipping.

Buyer Protection does not cover:

  • Change of mind.
  • Minor condition differences that fall within the stated grade.
  • Items confirmed delivered by tracked shipping where the buyer claims non-receipt.
  • Disputes raised outside the 3-day window after expected delivery.

Timescales

  • You must raise a dispute within 3 days of the expected delivery date.
  • Waevin will acknowledge your dispute within 24 hours.
  • We aim to resolve all disputes within 72 working hours of the seller's response deadline passing.
  • The decision of the Waevin administration team is final and binding.

11. Disputes

The dispute process is as follows:

  1. 1The buyer raises a dispute through the order detail page, selecting a reason category and providing a written description. The buyer may upload up to 4 photos as evidence.
  2. 2Escrow is frozen immediately upon dispute submission.
  3. 3The seller is notified by email and has 48 hours to submit a written response and counter-evidence (up to 4 photos).
  4. 4If the seller does not respond within 48 hours, the dispute is automatically escalated to Waevin administration.
  5. 5A Waevin administrator reviews both submissions and makes a ruling. Both parties are notified of the outcome by email.
  6. 6Escrow is released or refunded in accordance with the ruling.

Only one dispute may be raised per order. The decision of the Waevin administration team is final and binding on both parties. Both buyer and seller may view the full dispute timeline but cannot edit their submissions after posting.

12. Withdrawals

Sellers may withdraw their available wallet balance to their Stripe Connect-linked UK bank account at any time, subject to the following conditions:

  • The seller must have completed Stripe Connect onboarding and have payouts enabled.
  • Withdrawals are not available while any of the seller's orders have an open dispute.
  • Funds must be in the available balance, not the pending balance. Pending funds become available once escrow is released.

Funds typically arrive in the seller's bank account within 1 to 3 working days, depending on the bank. Waevin is not responsible for delays caused by the seller's bank.

13. Intellectual property

Waevin owns all intellectual property in the Waevin platform, including the name, logo, software, and user interface design.

Card names, set names, artwork, and related intellectual property are owned by their respective rights holders, including The Pokemon Company International, Wizards of the Coast, Konami, Bandai, and Topps. Waevin uses these names and images solely for the purpose of identifying cards on the secondary market, which constitutes fair use for secondary market trading.

You own the content you upload to the platform — including listing photographs and descriptions. By uploading content, you grant Waevin a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use that content on the platform and in related marketing materials for as long as the listing remains on the platform.

You warrant that any content you upload does not infringe the intellectual property rights of any third party.

14. Counterfeit policy

Waevin operates a zero-tolerance policy on counterfeit cards. This includes but is not limited to fake Pokémon cards, counterfeit Yu-Gi-Oh cards, and any other cards not produced by the original manufacturer.

Any listing suspected of offering counterfeit items will be removed immediately without notice. The seller's account will be permanently suspended. All open orders will be cancelled and buyers refunded.

Serious or repeated offences may be reported to the relevant intellectual property holder, Trading Standards, or law enforcement authorities. We cooperate fully with any such investigation.

15. Limitation of liability

Waevin is a marketplace platform and is not liable for the quality, safety, legality, or availability of any item listed or sold through the platform. The contract of sale is between the buyer and seller.

To the maximum extent permitted by law, Waevin's total liability to you in any circumstances — whether in contract, tort, or otherwise — is limited to the Buyer Protection fee paid on the relevant transaction.

We are not liable for any indirect, consequential, special, or punitive losses, including loss of profits, loss of data, or damage to reputation, even if we have been advised of the possibility of such losses.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

16. Indemnity

You agree to indemnify, defend, and hold harmless Waevin, its directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your listings or the items you sell; (b) your conduct on the platform; (c) your breach of these Terms; or (d) your infringement of any third party's intellectual property or other rights.

17. Termination

You may close your account at any time by contacting us at legal@waevin.com. Account closure is subject to our data retention obligations under UK GDPR.

Waevin may suspend or permanently terminate your account at any time where:

  • You have breached these Terms.
  • We have reasonable grounds to believe fraudulent activity has taken place.
  • Your conduct is harmful to other users or to the platform.
  • We are required to do so by law or regulatory authority.

On termination for fraud or serious breach, any escrow funds will be returned to buyers. On termination for other reasons, any available wallet balance will be paid to the seller's connected bank account within 14 days.

Where we suspend your account rather than terminate it, we will tell you the reason and the expected duration, unless disclosure would compromise a fraud investigation or other legal obligation.

18. Changes to terms

We may update these Terms from time to time. Where changes are material — meaning they significantly affect your rights or obligations — we will give you at least 14 days' notice by email before the changes take effect.

Continued use of the platform after the effective date of a change constitutes your acceptance of the updated Terms. If you do not accept the new Terms, you must stop using the platform and close your account before the effective date.

19. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from or related to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
